1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and the operator of Truck Queue("we," "us," or "our") governing access to and use of the Truck Queuewebsites, mobile applications, and related services (collectively, the "Service"). By creating an account, checking in a driver, joining a queue, or otherwise using the Service, you agree to these Terms and our Privacy Policy.
2. Who may use the Service
The Service is intended for commercial transportation and warehouse operations in the United States. You must be at least 18 years old and able to form a binding contract. You represent that information you provide is accurate and that you will keep it current.
- Drivers use the Service to join facility queues, view line position, receive door assignments, and complete check-in steps required by a facility.
- Fleet accounts manage drivers under a fleet identifier and may purchase fleet subscriptions that cover approved drivers.
- Facility (shipping and receiving) accounts operate the live queue board, check in drivers, assign doors, and configure optional workflows such as photo verification and facility location settings.
3. Accounts and security
You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly at dockqueuesupport@gmail.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or pose a security risk.
4. Facility check-in and driver matching
When a facility checks in a driver, the facility enters identifying information (such as name, carrier, truck number, and phone). Drivers join the queue using a code provided by the facility. The Service may require that the driver's account profile match the facility's check-in record before linking the visit. Facilities are responsible for entering accurate check-in data; drivers are responsible for maintaining an accurate profile.
5. Facility location and geofencing
The Service includes optional geofencing features that tie certain actions to a facility's physical location:
- Facility setup: Before using the queue board and other desk features, a facility must save a street address and location pin in Settings, along with a vicinity radius of up to one (1) mile from that pin.
- Facility staff: Once a location pin is configured, authorized desk users must be physically within the configured vicinity to use the queue board, check in drivers, assign doors, and perform other operational actions protected by geofencing.
- Drivers: Drivers must be within the same facility-configured vicinity to join a queue using a check-in code. If you are outside that area, the Service will deny the join and display an explanatory message.
- Location permission: Geofencing requires your device to share precise location when you use affected features. You may disable location in your browser or device settings, but those features will not work without it.
Facilities are responsible for placing the pin accurately at their building or dock area and for choosing a reasonable radius. GPS and network location can be imprecise; we do not guarantee that geofence results will always match real-world boundaries. You agree not to spoof, falsify, or manipulate location data to bypass geofencing.
6. Subscriptions, trials, and payments
Paid features are offered on subscription or usage-based plans described at checkout. Prices, capacity limits, and included features are shown before you purchase. Unless stated otherwise:
- Subscriptions renew automatically each billing period until canceled through your account or payment provider.
- Free trials, when offered, convert to paid subscriptions unless canceled before the trial ends. Eligibility for trials may be limited to one per identity or organization.
- Driver Pro day passes and monthly Driver Pro subscriptions are separate from facility and fleet plans. Fleet subscriptions include Driver Pro for approved fleet-managed drivers while the fleet plan is active.
- Payments are processed by third-party payment processors (such as Stripe). We do not store full payment card numbers.
Except where required by law, fees are non-refundable. We may change prices with reasonable notice; continued use after a price change constitutes acceptance.
7. SMS and notifications
The Service may send transactional SMS messages (for example, door assignments or verification codes) to phone numbers you provide. Message and data rates may apply. You may opt out of marketing messages where offered; transactional messages needed to operate the Service may still be sent. Carriers are not liable for delayed or undelivered messages.
8. Photos and facility verification
Facilities may require drivers to upload photos (for example, safety or compliance images). Drivers grant the facility and us a limited license to store, display, and review those images solely to operate the Service. Facilities are responsible for using photo requirements in compliance with applicable law and their own policies.
9. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of facility rules.
- Impersonate another person or misrepresent vehicle, carrier, or identity information.
- Attempt to bypass queue limits, billing, geofencing, or security controls.
- Spoof, falsify, or relay misleading GPS or device location data to access geofenced features from outside the permitted area.
- Scrape, reverse engineer, or overload the Service without written permission.
- Upload malware or content that infringes others' rights.
10. Intellectual property
We own the Service, software, and branding. You receive a limited, non-exclusive license to use the Service for its intended purpose. You retain rights to content you submit; you grant us a license to host and process that content to provide the Service.
11. Third-party services
The Service may integrate with third parties (payment processors, SMS providers, email delivery, map or location services, and hosting). Your use of those services may be subject to their terms. We are not responsible for third-party acts or outages.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OPERATION, ACCURATE WAIT TIMES, ACCURATE GPS OR GEOFENCE RESULTS, OR THAT FACILITIES WILL ASSIGN DOORS WITHIN ANY PARTICULAR TIME. QUEUE POSITION, WAIT ESTIMATES, AND LOCATION-BASED ACCESS DECISIONS ARE INFORMATIONAL ONLY.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE STATES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
14. Indemnification
You will defend and indemnify us against claims arising from your misuse of the Service, your content, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.
15. Dispute resolution and governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where federal law applies. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. You may also have rights under state consumer protection laws that cannot be waived by agreement.
Before filing suit, you agree to contact us at dockqueuesupport@gmail.com and attempt in good faith to resolve the dispute for at least thirty (30) days.
16. Changes and termination
We may modify the Service or these Terms. We will post updated Terms with a new effective date. Material changes may be communicated by email or in-app notice where practicable. You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or for operational reasons.
